This Privacy Policy, which is part of our Terms of Use, governs your visit to this Web site and any other Web site operated by ResourceWise and its wholly owned subsidiaries Forest2Market, Fisher International, Tecnon OrbiChem, Wood Resources International and PRIMA Markets (“we”, “us”, “our”) collect, store, use, disclose and transfer the personal information you provide through any of the Sites. “Personal Information” is data that can be used to uniquely identify or contact a single person.

Review this Privacy Policy before you submit any Personal Information to us on our Sites.  By accessing this Site, you signify that you accept and agree to all of the terms of this Privacy Policy, and the practices described in it as well as the Terms and Conditions of Use.  If you do not agree with any term of this Privacy Policy or the Terms and Conditions of Use, please do not use this Site or submit any Personal Information.

COMPLIANCE WITH PRIVACY SHIELD FRAMEWORK

ResourceWise complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States.  ResourceWise has certified to the U.S. Department of Commerce that it adheres to the Privacy Shield Principles.  If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, and to view our certification, please visit https://www.privacyshield.gov/

HOW WE COLLECT PERSONAL INFORMATION; TYPES OF INFORMATION WE COLLECT. Generally, we do not ask you to provide any Personal Information to browse our Sites.  

We, or our service providers, may also collect personal information about you through your use of the Sites.  This information includes online activity information and technical information about your usage activities, including, without limitation, your IP (Internet Protocol) address and other publicly available information, such as Internet browser information, operating system information, dates and times of a particular users visit and/or click path taken through the site, lookup information, and information that may be publicly available in connection with an IP address such as general location of the user, business names and contact information, to help diagnose problems with our server, administer our Site and identify our users. 

We use technical information or information about your online activity that may be collected automatically to enhance the functionality of our Sites and to make your activities at our Sites more convenient and efficient.  This aggregate information provides statistics that we use to analyze, market and improve our Sites and business.  Please also see additional information on our cookie usage in “COOKIES AND OTHER TRACKING TECHNOLOGIES” section below. 

If you wish to participate in some of the features and services the Sites may offer, including features and services available to registered users, such as the purchase of any of our products, we may ask you to provide certain Personal Information.  In some instances, if you choose not to provide the requested information, for example in order to sign up for a newsletter or RSS feed, to register with one of our Sites or to participate in surveys, you may not be able to access all of the areas on the Sites or participate in all of their features. 

Types of Personal Information we may collect include name, email address, phone number, title, company and industry.  We may collect this information via the Hubspot Landing Pages on our Sites.

We may collect Personal Information you provide while using our Sites during an online transaction (including your name, email address, phone number, credit card or account information, the type of services or products ordered or purchased, shipping and billing addresses, and the date of the order or license purchase and, if applicable, company name, company tax ID, and work phone number), any online account information, e-mail addresses, and other information you might provide to us. In the case of placing an order, this information is essential for verification and shipping purposes, and we may also need to contact you about your order. We will store your shipping and billing information if you create an account with us, but this information will not be used by anyone but we and our vendors who provide services related to our services.  We may also offer the option to interact with one of our representatives directly while using the Sites in order to ask questions, request information, and to assist you in making a purchase or using our services.

If at any time you provide a third party’s Personal Information to us, whether in the form of a name, shipping address, email address or other, you warrant that you have the permission of the person whose information you submit to share that information with us and you agree to indemnify, defend and hold harmless ResourceWise and its affiliates and third-party service providers from and against any claims, liabilities, costs and expenses arising in connection with your sending or providing that information to us. 

COOKIES AND OTHER TRACKING TECHNOLOGIES. Cookies are small files placed on your computer's hard drive by a Web site when you access the site, so that the site remembers your preferences when you visit subsequently.  Like many other Web sites, our Sites use cookies.  Most Web browsers automatically accept cookies but allow you to modify security settings so you can approve or reject cookies on a case-by-case basis.  If you do not accept our use of cookies on the Sites, you may modify your browser settings to reject cookies. If you modify your browser settings so that your computer does not accept cookies from us, then we cannot guarantee that all functions of the Sites will operate as intended.

HOW WE USE PERSONAL INFORMATION. We may use Personal Information to communicate directly with you, such as to respond to inquiries, confirm registration information or your desire to opt-in to marketing communications from us, to inform you if you have won a sweepstakes or contest, to send you communications (including to mail or email invoices to you) and offers by mail or email, to fulfill your request for an online newsletter, blog or other online subscription service, to keep you informed about the status of any transactions, or to offer additional information about other database services, products, programs, services, promotions or offers that may be of interest.

We may use Personal Information to protect the security and integrity of our Sites, to correct technical problems and malfunctions on our Sites, to process your information, to take precautions against liability. 

We may use Personal Information to identify your product and service preferences, to improve our promotional offers, customer service and overall user experience on our Sites, and to research, develop, manage and improve our Sites. 

HOW WE SHARE PERSONAL INFORMATION. We may share Personal Information with third parties who provide services on our behalf.  These parties may use the Personal Information solely in conjunction with the specific services they provide for us (e.g., data processing, fulfillment of an order, managing and enhancing customer data, responding to your question or comment, providing a promotional prize, deployment of a consumer survey, investigation of a complaint, etc.).  Our service providers are obligated to protect your Personal Information.   We may also provide third parties with aggregate statistics about traffic patterns, and related site information. This data reflects site usage patterns gathered during thousands of customer visits to our Sites each month, but it does not contain behavioral, profile, or identifying information about any individual user.  We also may transfer, sell or assign your personal information to third parties as a result of a sale, merger, consolidation, change of control, transfer of assets, reorganization or liquidation.  In that event, we will use reasonable efforts to require that the transferee use Personal information in a manner consistent with this Privacy Policy. 

We reserve the right to disclose any Personal Information as needed if such information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements, or if we are required to do so by law, regulation, subpoena, court order or by a government entity.  We also may disclose Personal Information to third parties in response to legal request such as court orders, subpoenas, and specific requests from law enforcement agencies, if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law or to cooperate in any legal investigation. 

HOW WE PROTECT YOUR PERSONAL INFORMATION.

We take certain physical, electronic and administrative security precautions to maintain the security and accuracy of Personal Information we collect, including limiting the number of people who have physical access to our database servers, as well as employing electronic security systems and password protections that guard against unauthorized access, loss, misuse or alteration. Only personnel authorized by us, including service providers, have access to the data.  Notwithstanding the above, due to the open nature of the Internet, we cannot guarantee that any information stored on our servers, or transmitted to or from a user, will be free from unauthorized access.  By using our Sites, you acknowledge that you understand and agree to assume these risks. Please note that e-mail is not encrypted and is not considered to be a secure means of sharing Personal Information with us.

If you receive any online newsletter or similar promotional e-mail communication from us, you will always have the option of replying and inserting “unsubscribe” in the subject line, by following the “Update Email Profile” link located in the website footer, or by emailing us your changed preferences at any one of our Sites.  (If you use more than one e-mail address, then send your opt-out e-mail from, or ask to unsubscribe for, each of your e-mail addresses.). Our Sites may include discussion forums or other interactive areas or services, including blogs, chat rooms, bulletin boards, message boards, online hosting or storage services, or other areas or services in which you or third parties create, post or store any content, messages, comments, materials or other items on our Sites (collectively, “Interactive Areas”). Interactive Areas are open to the public and any Personal Information you post or provide may be viewable by others.  We are not responsible for any Personal Information you submit in connection with the Interactive Areas, nor are we responsible for how others might use that information. Interactive Area postings may be retained indefinitely.

For the convenience of our users, our Sites often contain links to other web sites which are not under our control.  We are not responsible for the privacy practices or the content of such websites.  You acknowledge that we are not responsible for the accuracy, copyright compliance, legality, decency, data collection, privacy policies, or any other aspect of the content of sites it does not operate or control. Your accessing the links to any other off-site pages or other sites is at your own risk and subject to the applicable privacy policies and terms and conditions of such websites. 

DO-NOT-TRACK; THIRD PARTY TRACKING

Unless your browser settings are configured to make your online activities and publicly available information about your online activities invisible to usage analytics tools, we do not presently have the capability to omit you from usage analytics to the extent your browser only sends us a “do not track” message and does not otherwise screen you from tracking without any action on our part.  To learn more about browser tracking signals and “do not track”, visit http://allaboutdnt.org.  Third parties, other than our service providers, do not have our permission to track which websites you visit prior to and/or after visiting our Sites.  That said, we cannot control all third-party tracking, and there may be third-party tracking without our knowledge or consent. 

YOUR CALIFORNIA PRIVACY RIGHTS

Pursuant to Section 1798.83 of the California Civil Code, California residents have the right to request from a business with whom the California resident has an established business relationship: (1) What types of personally identifiable information, if any, of the California resident the business shares with third parties for direct marketing purposes of those third parties; and (2) the identities of the third parties with whom the business has shared such information in the immediately preceding calendar year.

 

We do not, at this time, disclose such information to third parties for their direct marketing purposes.  If we change this policy, we will update this provision and provide instructions on how you may make a request for details.  If any other state enacts a similar law as the California law, then this provision will also apply to such state. 

INTERNATIONAL USERS AND MINORSTHIS SITE IS ONLY INTENDED FOR VIEWING IN THE UNITED STATES IF YOU ARE EIGHTEEN (18) YEARS OR OLDER and not a minor in your state of residence.  We do not knowingly collect personal information from children under 13.  If we learn that we have collected the personal information of a child under 13 we will take steps to delete the information as soon as possible.

TRANSFER OF DATA TO THE UNITED STATES. The Sites are designed and targeted to users who reside in the United States and are governed by and operated in accordance with the laws of the United States.  If you are located in the EU, please review our EU-U.S. Privacy Shield Framework Provisions below.  We make no representation that this Site is operated in accordance with the laws or regulations of, or governed by, other nations.  If you are located outside of the United States, please be advised that any information you provide to us will be transferred to the United States and that by submitting information, you explicitly authorize its transfer. Children under the age of majority in any jurisdiction outside of the United States should not provide personal information without their parent’s consent.

EU-U.S. Privacy Shield Framework Provisions

Scope

Our commitment to the EU-U.S. Privacy Shield Framework covers personal data collected from the EU and transferred to the U.S., including customer and vendor data, and other personal data.  In this Privacy Policy, we refer to Personal Information which is information about an identified or identifiable individual that is received by ecomdash from the EU and recorded in any form. 

Right of Access

If you are an EU individual, you have the right to access Personal Information we hold about you.  If such information is inaccurate or processed in violation of the Privacy Shield Principles, you may also request that such information be corrected, amended or deleted.  See “YOUR CHOICES REGARDING USE OF THE INFORMATION WE COLLECT” section above and “CONTACTING US” below for information on how to exercise this right.

Choice. 

If you are an EU individual, you have the right to opt out of (i) disclosures of your Personal Information to third parties not identified at the time of collection or subsequently authorized and (ii) uses of Personal Information for purposes materially different from those disclosed at the time of collection or subsequently authorized.  See “YOUR CHOICES REGARDING USE OF THE INFORMATION WE COLLECT” section above and “CONTACTING US” below for information on how to exercise this right. 

Onward Transfers

If we receive Personal Information subject to our certification under the Privacy Shield and then transfer such information to a third-party service provider acting as an agent on our behalf, we have certain liability under the Privacy Shield if the agent processes such information in a manner inconsistent with the Privacy Shield except when we are not responsible for the event giving rise to the damage.

RESOURCEWISE INTERNAL RECOURSE MECHANISM

In compliance with the Privacy Shield Principles, we commit to resolve complaints about our collection or use of your Personal Information.  EU individuals with inquiries or complaints should first contact us by email at information@ResourceWise.com or by phone at 1.980.233.4010.  We will respond to your request within a reasonable timeframe, but in no event less than 45 days after receipt of your complaint. 

INDEPENDENT RECOURSE MECHANISM

If a complaint cannot be resolved through our internal process, we commit to cooperate with the panel established by the EU data protection authorities (“DPAs”) and comply with the advice given by the panel with regard to Personal Information transferred from the EU.  Such individuals may direct complaints about their Personal Information to their respective DPA. 

BINDING ARBITRATION

You have the possibility, under certain conditions, to invoke binding arbitration for complaints regarding Privacy Shield compliance not resolved by any of the other Privacy Shield mechanisms pursuant to the Privacy Shield’s Recourse, Enforcement and Liability Principle and Annex I of the Privacy Shield. 

REGULATORY OVERSIGHT

The Federal Trade Commission has jurisdiction over ResourceWise’s compliance with the Privacy Shield.

NOTIFICATION OF CHANGES. In the event our Privacy Policy should materially change, we will post those changes on this Privacy Policy, with a notice on the landing page of our Sites and in other places we deem appropriate.  All revisions will be posted to this Site and will become effective on the date that the modified policy is posted on our Site.  Your continued use of our Sites following the posting of changes means you accept those changes.
